Shri Suraj Bhan, respondent no. 1 died on 17.10.2002 leaving behind his two sons, namely, Vijay Kumar and Sri Ajay Kumar as his legal heirs.
Sri A.B. Singhal, Advocate and Sri R.B. Singhal Advocate state that Sri Ajay Kumar is missing since long and, therefore, his name need not be substituted and the name of Sri Vijay Kumar be substituted.
In view of the above, the application is allowed. In front of the name of Sri Suraj Bhan, the word dead be mentioned and the name of Sri Vijay Kumar be substituted as respondent no. 1/1. The heirs are already represented. The substitution be carried out within two weeks.
