The petitioners have filed this petition for a direction upon the Development Authority to remove the illegal commercial activities, which are being carried out by respondent no.6, from House No.H-200, Sector-23, Sanjay Nagar, Ghaziabad.
Sri C.P. Gupta, learned counsel, who appears for respondent no.6 accepts that all commercial activities from the house in dispute have been stopped.
Sri Vrindaban Misra, learned counsel appearing for the Ghaziabad Development Authority submits that all commercial activities from the house in question have been stopped. He has prepared an affidavit of the Secretary of the authority to this effect, but it could not be served as counsel for the petitioners was not available.
We have perused the aforesaid affidavit and have taken the same on record. It clearly mentions in paragraph 3, that sweet shop that was being run from the said house has been shut down and that no commercial activity is being carried out from the house in question.
In view of the above, the desired relief as claimed in the petition, has already been granted to the petitioner and as such it requires no further order.
The writ petition accordingly stand disposed of with clear stipulation that the Ghaziabad Development Authority would not permit any commercial activity in the residential accommodation/house and that in future also no such activity would be carried out from the house in question.
