This is a second application under Section 482 Cr.P.C. seeking to quash the cognizance order dated 17.07.2018 (arising out of Case Crime No.0048 of 2018), under Sections 419, 420, 467, 468 and 471 IPC, P.S. Mauaima, District-Allahabad pending in the Court of Special Chief Judicial Magistrate-Allahabad.
Earlier an application seeking to quash the entire proceedings of Case No.2547 of 2018 (State Vs. Jamaluddin) (arising out of Case Crime No.0048 of 2018), under Sections 419, 420, 467, 468 and 471 IPC, P.S. Mauaima, District-Allahabad was filed by the applicant being application under Section 482 Cr.P.C. No. 26469 of 2018 that came to be dismissed on merits summarily by an order dated 8.08.2018. This being a second application virtually for the same relief with a few cosmetic changes is not at all maintainable.
This application is, accordingly, dismissed as not maintainable.
This order would not prevent the applicant from pursuing other remedies open to him under the law.
