Heard Sri Ravindra Kumar Dwivedi, learned counsel for the applicant and Sri Abhinav Prasad, learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed for a suitable direction to the Chief Judicial Magistrate, Etah to decide the Complaint Case No.581 of 2017 (Jamaluddin Vs Jamaluddin), under Section 138 N.I. Act, P.S. Mirhachi, District Etah, pending in the Court of Chief Judicial Magistrate, Etah, within stipulated period.
No useful purpose would be served in keeping the petition pending, which is finally disposed of with a direction to Chief Judicial Magistrate, Etah to consider and decide the Complaint Case No.581 of 2017 (Jamaluddin Vs Jamaluddin), under Section 138 N.I. Act, P.S. Mirhachi, District Etah, pending in the Court of Chief Judicial Magistrate, Etah, most expeditiously, preferably within a period of six months from the date of production of certified copy of this order, before concerned court below, in accordance with law, after hearing the concerned parties, without granting unnecessary adjournment to either of the party, in case the proceedings of the aforesaid case, is not stayed by any Court.
