JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) Rule.
Mr.Pandya, learned APP waives service of notice of Rule.
The present application has been preferred by the applicant - convict for temporary bail on the ground that he wants to make arrangement for engagement of his yonger brother.
It appears from the jail that the applicant - convict was released on bail from 27.11.2011 to 6.12.2012 on the ground to perform post death religious ceremony of his father and the present ground is not such where the presence of the applicant - convict can be said to be indispensable.
Under these circumstances, the discretion does not deserve to be exercised. Therefore, the application is rejected. Rule discharged.
