[Order of the Court was made by K.K.SASIDHARAN, J.] The petitioner filed this writ petition to direct the 2nd respondent to remove the encroachment said to have been caused by the 4th respondent in respect of the Kali Natham (Government Poramboke) in S.F.No.261/2, in New S.F.No.682/1 in Thuvarankurichi Town Panchayat, Marungapuri Taluk, Trichy District.
2.The materials produced by the learned Special Government Pleader would indicate that the land is classified as Kali Natham (Government Poramboke).
3.We, therefore, direct the second respondent to consider and dispose of the representation submitted by the petitioner on merits and as per law. Such exercise shall be completed within a period of three months from the date of receipt of a copy of this order.
4.We make it clear that in any case, there is an encroachment in respect of the land in S.F.No.261/2, in New S.F.No.682/1, action should be taken for removal of encroachment, whether it is by the petitioner or the 4th respondent or anybody else of course by giving them opportunity to state their case.
5.This writ petition is disposed of with the above direction. No costs.
