Heard Sri Babhru Vahan Singh, learned counsel for the petitioner and learned Standing Counsel.
This writ petition has been filed for issuance of mandamus commanding the respondent no.2-Deputy Director of Consolidation, Azamgarh to decide the restoration application no. 280 dated 23.4.2010 filed by the petitioner in Revision No. 256, 257 and 258 under Section 48 of U.P.C.H. Act within stipulated time.
The contention of learned counsel for the petitioner is that against the order dated 3.1.1975, petitioner filed a recall application on 23.4.2010, which remain pending till date.
Under these circumstances, respondent no.2-Deputy Director of Consolidation, Azamgarh is directed to decide the restoration application no. 280 filed for recalling the order dated 3.1.1975 as expeditiously as possible preferably within a period of four months from the date of production of certified copy of this order.
Writ petition is, accordingly, disposed of.
