Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the State respondents and perused the record.
Present petition has been filed with a prayer to direct the respondent no. 1- Sub Divisional Magistrate Tehsil Nichlaul, District Maharajganj to decide the recall application dated 7.11.2020 in Case No. 68 of 2013-14 (Computerized Case No. T20170547021959) (Sakir Ali vs. Jamir Ali), under Section 176 of UP ZA LR Act, 1950 within stipulated period.
In the facts and circumstances of the case, the present petition is finally disposed of with the direction to the respondent no. 1 to expedite the hearing of the aforesaid recall application and decide the same on its own merit, in accordance with law, expeditiously preferably within a period of four months from the date of production of a self verified copy of this order and no unnecessary adjournments shall be granted to the parties provided there is no legal impediment as well as the functioning of the court is not affected by any reason related to COVID-19 Pandemic as well as the lawyers are not abstaining from the judicial work.
With the aforesaid observations/ directions, the present petition is finally disposed of.
