Respondents Petition under Article 226 of the Constitution of India, praying that in the circumstances stated in the affidavit filed herein, the High Court may be to pleased issue an appropriate writ or order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents without conducting inspection going to demolish the House of the petitioner i.e. H.No.7-23-30, Sy.No.43/12, 44/13, Ward No.9, Block No.2, Prakasham Road, Tenali, Guntur District, is illegal, arbitrary, and violative of Article 14, 19 and 21 of the Constitution of India and consequently to direct the respondents not to demolish the stair case and lift room of the petitioner house bearing No.7-23-30, Sy.No.43/12, 44/13, Ward No.9, Block No.2, Prakasham Road, Tenali, Guntur District.
The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and the order of the High Court orders dated 21.04.2011, 28.04.2011 made herein and upon hearing the arguments of Sri. B. Devadas, Advocate for the Petitioner, GP for Municipal Admn. for the Respondent No.1, Sri S. Nageswara Reddy for the Respondent No.2, the Court made the following.
