.. Petitioners and State of Andhra Pradesh, Rep. by its Principal Secretary (Civil Supplies), Saifabad, Hyderabad, and others.
.. Respondents Counsel for the petitioners: Mr. Mangena Sree Rama Rao Counsel for respondent No.1: AGP for Civil Supplies (AP) Counsel for respondents 2&5: AGP for Revenue (AP) Counsel for respondent No.3: AGP for Home (AP) Counsel for respondent No.4: AGP for Panchayat Raj Counsel for respondent No.6: Mr. G. Elisha The court made the following:
ORDER:
The grievance of the petitioners in this writ petition is that respondents 8 and 9 are seeking to establish a retail petroleum outlet over the lands adjacent to the petitioners’ residential houses in R.S.No.265/2 of Jinnuru Village of Poduru Mandal, West Godavari District.
At the hearing, it is submitted by Mr. Mangena Sree Rama Rao, learned counsel for the petitioners, that his clients have filed objections before respondent No.2 against grant of licence to respondents 8 and 9 and that so far, no decision has been taken by respondent No.2.
In my opinion, the writ petition is premature, as no licence has been granted by respondent No.2 in favour of respondents 8 and 9 for establishing retail petroleum outlet. Therefore, I am not inclined to entertain this writ petition at this stage. However, respondent No.2 is directed to consider the objections, if any, filed by the petitioners, while dealing with the application of respondents 8 and 9 for grant of licence.
Subject to the above direction, the writ petition is dismissed.
As a sequel to the dismissal of the writ petition, W.P.M.P.No.47651 of 2014 shall stand disposed of as infructuous.
