JUDGMENT / ORDER

. Respondent/Complainant Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to direct the Station House Officer, Musheerabad Police Station, Hyderabad District, to release the petitioners on bail in the event of their arrest in connection with Crime No.177 of 2013 of Musheerabad Police Station, Hyderabad District, in the interest of Justice.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri T. Pradyumna Kumar Reddy, Advocate for the Petitioners and of the Public Prosecutor for the Respondent, the Court made the following.
ORDER:
“Petitioners are A1 and A2. They seek for grant of anticipatory bail. They allegedly committed offences under Sections 420, 409 and 120-B IPC.
The learned Additional Public Prosecutor submitted that the audit report disclosed that the petitioners misappropriated an amount of Rs. 7.14 Crores and that the investigation is still at the threshold.
The learned counsel for the petitioners submitted that the petitioners are innocent of the offences levelled against them.
The petitioners are 72 years and 71 years old. In view of their age and their defence, I consider it appropriate to enlarge the petitioners on anticipatory bail. However, in view of the nature of the offences alleged, I consider it appropriate to enlarge the petitioners on bail only on terms.
Consequently, this Criminal Petition is allowed. The petitioners shall surrender before the learned XVII Additional Chief Metropolitan Magistrate, Hyderabad, within two weeks from today. On such surrender, the learned XVII Additional Chief Metropolitan Magistrate, Hyderabad, shall enlarge the petitioners on bail on a personal bond of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties each in a likesum to his satisfaction.”
