Mr.Pandya, learned APP waives service of notice of Rule.
By way of this application, the applicant - convict has prayed that he be enlarged on temporary bail on the ground that he wants to attend the bismilla ceremony of his daughter, which is scheduled on 18.4.2012.
In our view, the ground is not such, where the presence of the applicant - convict can be said as indispensable. Further, from the jail remarks, we find that the applicant was already on temporary bail from 16.12.2011 to 31.12.2011.
Considering the totality of the facts, we find that the discretion does not deserve to be exercised in this case. Hence, the application is rejected. Rule discharged.
