(Per : HONOURABLE MR.JUSTICE A.L.DAVE) The matter is called out twice, the party-in-person is not present. On earlier occasion also on 12.6.2012, the party-in-person had chosen not to appear before this Court. Learned APP has placed before us the jail history of the prisoner. It indicates that the prisoner has absconded for 1526 days when he was admitted to furlough in the year 2007 and was restored to prison on 9.10.2011 after arrest by police. In this background, this application cannot be entertained. Hence rejected.
