Heard learned counsel for the applicant, learned AGA and perused the record.
Learned counsel for the applicant submitted that showing four cases mentioned in the gang chart the applicant was challanned under Gangster Act and in those cases the applicant is on bail. He further contended that the applicant will not misuse the liberty of bail, if he is released on bail. However, in the present case the applicant is in jail since 1.5.2009.
In view of the above, without expressing opinion on merit, let the applicant Jakir be enlarged on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned in Case Crime No. 464 of 2009 under Section 3(1) of Gangster Act, PS Hayat Nagar District Moradabad.
