JUDGMENT / ORDER

The petitioner herein is the 9th accused in C.C. No.65/2012 of the Judicial First Class Magistrate Court, Taliparamba. Now it is more than three years since the date of commission of the alleged offence. The petitioner is now aged 37 years. He is already in some rank lists published by the Kerala Public Service Commission for appointment. His grievance is that if trial of the case is delayed, and prosecution is not cleared, he will lose employment. Once such opportunity is lost, he will not be able to attempt any further examination because by that time he will cross the age limit. In such a situation, he seeks a direction from the court below for expeditious trial and disposal of the case. Of course, I feel it inappropriate to make a direction for time bound disposal because the court below is a heavy court. Still the petitioner's grievance will have to be seriously and earnestly considered by the trial court. He can very well approach the trial court with Crl.M.C No.7201 of 2014 2 necessary application for expeditious disposal. Once such an application is filed stating the grounds and grievance of the petitioner, the trial court will consider his application seriously and take appropriate decision.
With these observations this Criminal Miscellaneous Case is closed. However, earnest efforts shall be made by the court to dispose of the case within a period of six months. This may not be taken as a direction for time bound disposal.
