ORDER:
Heard learned Counsel for the petitioner and learned Standing Counsel for the respondents.
This Writ Petition was filed challenging order of the Chief General Manager of the respondents-Company dated 10.09.2009 rejecting the request of the petitioner for de-ration of CMD from 15000KVA to 14000KVA on the ground that the petitioner has ACD dues of Rs.2,19,70,538/- and FCA arrears of Rs.83,95,940/-.
This Court by order dated 12.11.2009 granted interim direction pursuant to which the request of the petitioner for de-
ration was given effect to. In view of the same, no further orders need be passed in the Writ Petition in so far as de-ration is concerned. However, in respect of the dues if any payable by the petitioner is concerned, it is left open to the respondents to recover the same in accordance with law.
The Writ Petition is accordingly disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
