JUDGMENT / ORDER

Heard Mr. P.M. Thakkar, learned senior advocate, for the applicants and it is submitted that allegations in the complaint are baseless inasmuch as initially as per terms and conditions of Member Client Agreement, including the power of attorney was given and so signed by the complainant in favour of the Company and its authorised officers and agents and further consent was also recorded accordingly. Even for dispute of any in nature an in-built mechanism of arbitration as per Clause 27 is available and without taking recourse now the complaint is filed which is contrary to decision of the Supreme Court so relied and made part of the application.
Considering the above, Rule.
Learned APP, waives service of rule on behalf of respondent No.1.
Ad-interim relief in terms of para 10(B) till final disposal of the application.
Notice as to interim relief returnable on 19.7.2012.
