Heard Sri Deepak Kumar Tripathi, learned counsel for the applicant, learned A.G.A. for the State and perused the record.
The present bail application has been filed by the applicant in Case Crime No.87 of 2017, under Sections 498-A & 304-B IPC and 4 of Dowry Prohibition Act, Police Station Shamshabad, District Agra, with the prayer to enlarge him on bail.
Having heard learned counsel for the applicant and learned AGA, I find that the applicant is the husband of the deceased, who died on account of firearm injuries. Her dead body was found in the fields. The applicant is the husband of the deceased has not offered any explanation whatsoever as to under what circumstance the deceased died.
In view of the aforesaid, I do not find it to be a fit case for grant of bail to the applicant.
The bail application is accordingly rejected.
Considering the fact that the applicant is in jail since 24.4.2017, the trial Court is directed to expedite the trial and conclude the same without granting unnecessary adjournment to either of the parties, on day to day basis, strictly in accordance with the provisions of Section 309(1) Cr.P.C., preferably within a period of six months from the date of production of a certified copy of the order.
Let a copy of this order be sent to concerned Court below for intimation and necessary compliance within a week.
