Heard learned counsel for the petitioner and learned Standing Counsel for the State respondents.
Notice need not be issued to the private respondent in view of the order proposed to be passed.
The petitioner is before this Court with the request to command the Sub Divisional Magistrate, Atrauli, Aligarh to pass appropriate order to remove the illegal Naali made by the fifth respondent from the petitioner Khet no.416-A and 416, expeditiously.
Learned counsel for the petitioner states that private respondent namely Ajit Singh, who is presently working as Sub Inspector, Kotwali has raised illegal construction over his holding. He has apprised to the Court that regarding his grievance, he has already moved detailed representation to the Sub Divisional Magistrate, Atrauli, Aligarh but the Authority has not paid any heed in the matter and as such, this Court should come to the rescue and reprieve of the petitioner.
Learned Standing Counsel very fairly states that in case the aforesaid representation is still pending, the same shall be considered and decided by the Authority concerned expeditiously.
In view of the above, without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, on consent, the writ petition is disposed of finally with a direction to the Sub Divisional Magistrate, Atrauli, Aligarh to look into the grievance of the petitioner and carry out spot inspection and thereafter pass appropriate order but certainly after according opportunity of hearing to all the stake holders in the matter.
