Heard learned counsel for the revisionist and learned AGA for the State.
The revisionist has approached this Court against the order dated 29.9.2018 passed by Family Court/Fast Track Court, Court No.2, Etah in Complaint Case No. 130 of 2017, under Section 125 (3) Cr.P.C., Police Station Nidhauli Kalan, District Etah, whereby the maintenance amount of Rs.1000/- per month alongwith the cost for hearing before the court at the rate of Rs.200/- have directed to be paid to the opposite party No.2.
Submission is that the applicant has denied his liability to pay any maintenance amount of the minor child of the opposite party No.2 because he has refused to accept the minor child as his son and also moved an application for DNA Test. During the pendency of such application, this order has been passed by the court below.
The opposite party No.2 is married with the applicant and therefore, the aforesaid order cannot be faulted.
The revision is disposed of with the direction to the court below to get the DNA test report and conclude the proceedings of the case under Section 125 Cr.P.C. within the period of four months positively from the date of production of certified copy of this order.
