Heard learned counsel for the petitioner and learned Standing Counsel for the State respondents.
Petitioner who was an elected Pradhan of village Mahepur Block Karanda, district Ghazipur has approached this Court with a prayer that a mandamus be issued to the respondents not to proceed with the second inquiry for the work done for the period 2010-2015 in respect whereof the inquiry has already completed and the report has been submitted.
Learned counsel for the petitioner submits that the complaint has been regularly made by the respondent no.
6 against the petitioner and the authority has wrongly entertained the same inasmuch as when the inquiry has already been conducted on another complaint, there is no justification to institute a fresh inquiry.
Be that as it may, we leave it open to the petitioner to raise this objection in the inquiry itself. At this stage, we are not inclined to interfere in the matter at the behest of the petitioner.
With the aforesaid liberty to the petitioner to raise objection and placing on record all relevant documents pertaining to the first inquiry in case the second inquiry is held, we dismiss the writ petition.
