Heard learned counsel for the petitioners; the learned A.G.A. for the respondents 1 and 2; and perused the record.
The instant petition seeks quashing of the first information report dated 21.11.2019 registered as Case Crime No. 557 of 2019 at P.S. Gulawati, District- Bulandshahar, under Sections 506, 504, 323, 366, 363 I.P.C.
The allegation in the impugned first information report discloses commission of cognizable offence inasmuch as it is alleged that informant's daughter, who is aged 16 years, has been enticed away by the accused and that when the accused were confronted, they threatened the informant.
There is no satisfactory evidence on record to demonstrate that the victim is an adult.
Under the circumstances, the matter would have to be investigated and therefore the prayer of the petitioners to quash the first information report cannot be accepted.
The petition is dismissed without prejudice to the right of the petitioners to apply for bail or anticipatory bail, as may be advised.
