Heard learned counsel for the applicants, learned AGA for the State and perused the record.
This application under Section 482 CrPC has been filed by the applicants with a prayer to direct the learned Additional Principal Judge, Family Court 1st, Jaunpur to decide the Case No. 429 of 2013 (Jainab Vs. Mohd. Sakib), under Section 128 CrPC, Police Station Sarai Khwaja, District Jaunpur within stipulated period.
Learned counsel for the applicants has submitted that applicant no.1 is the wife of opposite party no.2 and applicant nos. 2 to 7 are their children and applicant no.1 has filed an application under Section 128 CrPC on 18.07.2011, however till date, the said application has not yet been disposed of and the proceeding has been lingering-on, on one pretext or the other.
In view of the above, learned Additional Principal Judge, Family Court 1st, Jaunpur is decided to make all endeavours to decide the aforesaid application as expeditiously as possible, preferably within a period of four months from the date of filing of certified copy of this order without giving any unnecessary adjournments to either parties and there is no other legal impediment in deciding the aforesaid application.
With the aforesaid direction, this application under Section 482 CrPC is finally disposed of.
