Heard learned counsel for the applicant and learned AGA for the State.
The present 482 Cr.P.C. application has been filed to quash the charge sheet dated 21.05.2017 as well as entire proceeding of Case No.30544 of 2017 (State Vs. Sandeep Pandey and others) arising out of Case Crime No.105 of 2015, under Sections 420, 468, 471, 323, 504, 506 I.P.C, Police Station Govind Nagar, District Kanpur Nagar.
Learned counsel for the applicant submits that he has been falsely implicated by the police under the alleged sections.
In that view of the matter, he is permitted to move discharge application through counsel before the trial Court within a period of one month from today and the trial court shall decide the same within a period of one month from the date of production of a certified copy of this order along with application.
Till the discharge application is decided, no coercive measures shall be taken against the applicant.
With the aforesaid directions, application stands disposed of.
