Heard learned counsel for the petitioner and Sri Pranjal Mehrotra for respondent no. 3.
The petitioner is aggrieved by the demand notice dated 1.9.2018 whereby a sum of Rs. 25,62,750.22 paise has been demanded as electricity dues.
The submission of learned counsel for the petitioner is that without deciding his objections the assessment was finalized and the impugned demand has been raised.
Sri Pranjal Mehrotra has pointed out that petitioner was provisionally assessed and the provisional assessment was sent to the petitioner by registered post and thereafter upon giving notice and opportunity of hearing the final order of assessment was passed on 11.10.2018 as annexure 3 to the writ petition.
In view of the above assessment order, petitioner can not succeed in challenging the demand notice unless the assessment itself is challenged. The final assessment is appellable under Section 127 of the U.P. Electricity Act, 2003.
Accordingly, petition stands disposed of.
