Heard learned counsel for the petitioner, learned Standing Counsel for respondent Nos. 1 and 5 and Sri Sunil Kumar Misra, learned counsel for respondent Nos. 2, 3, 4 and 6.
The case of the petitioner is that his father was appointed as Assistant Cashier in Uttar Pradesh State Road Transport Corporation, Gorakhpur and retired from service on 30.11.1991 and since then he was getting his pension regularly. The father of petitioner died on 6.11.2017 and prior to that, his mother was also died on 2.4.2006. According to the petitioner he is only legal heir with 90% physical disability, therefore, entitled for family pension and same is not being paid to him. Therefore, for redressal of his grievance, petitioner has submitted a representation dated 11.12.2017 before respondent No. 4, but the same has not been decided till date.
Learned counsel for the petitioner has lastly prayed that a suitable direction may be issued to respondent No. 4 to decide the representation of the petitioner.
Sri Misra, learned counsel for respondent Nos. 2, 3, 4 and 6 has no objection to the prayer made by learned counsel for the petitioner.
In view of the facts and circumstances of the case, with the consent of parties, without adverting on the merits of the case, the writ petition is disposed of directing respondent No.4, Kshetriya Prabandhak Uttar Pradesh Parivahan Nigam Gorakhpur, Kshetra Gorakhpur to decide the representation of petitioner strictly in accordance with law expeditiously, preferably within a period of two months from the date of production of certified copy of this order.
Petitioner is at liberty to file a fresh representation along with certified copy of this order.
