Heard learned counsel for the petitioner and Sri Kuldeep Singh Chauhan, learned counsel for respondent no.2.
This petition has been filed to seek a restraint for extension of the limits of Nagar Palika Parishad, Marehra, Etah at Village Panchayat Saray Ahmad Khan and Village Panchayat Ahmad Nagar, Bamnoi. The counsel for the petitioner submits that without considering the objection made by him, a proposal has been taken to extend the limits of Nagar Palika Parishad. It is, however, admitted that the notification for it has not been issued and the petition was filed by the petitioner being a Pradhan of the Zila Panchayat. The petitioner is not now a Pradhan after the elections recently held and otherwise the counsel for the petitioner could not refer to any provision said to have been violated for taking proposal for extension of the limits/boundaries of Nagar Palika Parishad. In view of the above, the petition is for the sake of it and not in reference to any legal provisions so as to challenge the action of the respondents.
Accordingly, finding no merit in the petition for challenge, the same is dismissed.
