Heard Sri Atul Kumar Srivastava, learned counsel for the petitioner and the learned counsel for the respondents.
Learned counsel for the petitioner submits that petitioner's recall application dated 2.3.2020 Computer No. T202014360302528 in Original Suit No. 377 (Ram Raj Vs. Gaon Sabha) under Section 122B(4)F of U.P.Z.A. and L.R. Act is pending before the Sub Divisional Magistrate, Machhlishahar, District Jaunpur and the said authority be directed to decide such application on its own merit within stipulated time.
This prayer is not opposed by Sri Sunil Kumar Singh appearing for the respondent no. 24.
Accordingly, this petition is disposed of with a direction to the Sub Divisional Magistrate, Machhlishahar, District Jaunpur to consider and decide the aforesaid application within 90 days from the date of receipt of computer generated copy of the order being passed today in PDF Form on its own merit.
It is made clear that this Court is not expressed any opinion on merits of the entitlement of the petitioner.
Accordingly, this petition is disposed of.
