Hon'ble Abhinava Upadhya,J. Hon'ble Ravi Nath Tilhari,J.
Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the State- respondents.
The grievance raised in this writ petition is against respondent no.2, which is a private entity.
It is claimed that respondent no.2 has encroached upon the land of the petitioner.
In case, any private entity is interfering with the rightful possession and title over the land of the petitioner, the petitioner has to approach the Civil Court of competent jurisdiction for the redressal of his grievances. In a writ proceeding, such a grievance cannot be raised, which essentially requires adducing of evidence and cross- examination of witnesses.
The writ petition is mis-conceived and it is, accordingly, dismissed.
