Heard Sri Yogesh Kumar Mishra, learned counsel for the petitioner, Sri Dr. D.K. Tiwari, learned Additional Chief Standing Counsel for the State and perused the records.
It has been argued by learned counsel for the petitioner that in spite of measurement carried out by the Revenue Authorities, according to which, the boundary has come to be settled and yet the private persons are interfering with the possession of the petitioner.
In our considered opinion, any fixation of boundary justifying the land is for the purposes of identification only and such proceeding is only summary in nature.
It is left open for the petitioner to file a civil suit for injunction on the said basis against the private persons who are interfering with the possession and enjoyment over such land.
With the aforesaid liberty, the writ petition is dismissed.
