Sri Mahesh Prasad Yadav, learned counsel for the petitioner and Sri Pawan Shukla, learned A.G.A. for the State and perused the record.
This writ petition has been filed with a prayer to direct the respondents to reconsider and take fresh decision for premature release of the petitioner in view of the facts that co-accused Satya Prakash has already been released on bail by the Hon'ble Apex Court on the ground of a long period undergone by him as 33 years 11 months and 26 days.
Learned counsel for the petitioner submitted that premature release has been rejected by the Competent Authority but he has not been supplied a copy of the same, and he has come up before this Court with the prayer to reconsider the case of the petitioner for premature release on the ground that co-accused Satya Prakash has been released by the Apex Court for which he has submitted an application, but it appears that no such application is annexed with present petition.
In view of he same, we do not find any ground to keep the matter pending before this Court, hence, we dispose of this petition with the direction that it may be open for the petitioner to approach the Authority concerned for redressal of his grievance, who may consider the same expeditiously, if the same is prayed within six weeks from today.
