Learned counsel for the petitioner states that this petition may be dismissed as withdrawn with liberty to file a fresh appeal before the authority concerned.
Prima facie, it appears that the order impugned has been passed mechanically, despite the order of the First Appellate Authority in favour of the petitioner. This fact may also be considered by the appellate authority while rehearing the appeal.
If, the petitioner approaches the authority concerned with the stipulated time and/or beyond with delay condonation application, the authority concerned shall also consider the matter on merits.
With these observations, the writ petition is partly allowed and liberty aforesaid is granted.
