Heard learned counsel for the petitioner and perused the record.
In view of the order proposed to be passed, notices need not issue to the private-respondents.
After some arguments counsel for the petitioner made a prayer to direct the Additional District Judge (F.T.C.2nd), District Jaunpur to decide the Civil Appeal No. 26 of 2012 (Jai Prakash Vs. Bhola Ram and Others) within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the Additional District Judge (F.T.C.2nd), District Jaunpur to consider and decide the aforesaid appeal in accordance with law most expeditiously but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
