The present contempt petition has been filed for alleged violation/non-compliance of the order dated 25.10.2013 passed by the Writ Court in Writ Petition No.9911 (MB) of 2013. The petitioner's security granted earlier on State expenses was withdrawn and aggrieved by the aforesaid action of the authorities, he filed the aforesaid writ petition.
In pursuance to the notice issued in this contempt petition, a compliance affidavit of Mr. Rajesh Kumar, Superintendent of Police, Amethi has been tendered today in the Court by Sri G.K. Singh, learned Additional Chief standing Counsel, which is taken on record. A copy thereof has also been served on the learned counsel for the petitioner. Along with the aforesaid affidavit, a copy of the order dated 31.7.2019 taken by the District Level Committee authorized to assess the threat perception of whom the security cover has been granted, has been placed on record. By a detailed order, it has been said that there is no ground for providing the Government security to the petitioner as he does not face threat perception and, therefore, his security has been withdrawn.
In view of the aforesaid decision dated 31.7.2019 taken in the case of the petitioner, nothing survives in the present contempt petition, which is hereby dismissed as having become infructuous.
However, if the petitioner is aggrieved by the aforesaid decision dated 31.7.2019 taken by the District Level Committee to assess the threat perception for granting the security cover to the petitioner, he may approach the competent Court/forum, if he is so advised and law permits.
Contempt notice stands discharged.
