By way of the instant application, the applicant has prayed for a direction to Judicial Magistrate court no. 11 District Deoria to decide the complaint case no. 2301 of 2018 under section 138 N.I.Act( Jai Prakash Vs. Satya Prakash) P.S. Bhatani district Deoria pending in the court of Judicial Magistrate, Court no. 11, District Deoria within a stipulated/fixed period.
I have considered the submissions advanced by learned counsel for the applicant and perused the record.
Obviously, the court below is under obligation to expedite the proceeding adhering to the provision of Section 309 Cr.P.C. Therefore, no order need be passed by this Court.
Consequently, this application is disposed of.
