Heard Sri Amit Daga, learned counsel for the applicant, Sri I.P. Srivastava, learned A.G.A. for the State.
The first two bail applications of the applicant were rejected by this Court vide orders dated 22.4.2014 and 5.2.2016, hence this third bail application has been moved on behalf of the applicant.
The new ground which has been argued by the learned counsel for the applicant is that while rejecting the second bail application of the applicant this Court directed the trial court to expedite the trial of the present case within a period of eight months from the said date though the trial of the applicant has been separated from other co-accused persons, who were absconding but the same has not been concluded as yet and only four prosecution witnesses have been examined and the informant turned hostile, hence the applicant, who is in jail since 13.4.2014 be released on bail.
Learned A.G.A. vehemently opposed the prayer for bail and have submitted that the applicant has a criminal history of 12 cases and the trial is in progress.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Jai Prakash @ Jijju involved in Case Crime No. 45 of 2013 under sections 302, 393 I.P.C., police station Barhan, District Agra.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same on day to day basis within a further period of four months from the date of production of a certified copy of this order.
