JUDGMENT / ORDER

Heard the learned counsel for the petitioner and the learned standing counsel.
The learned counsel for the petitioner submitted that in view of the settled law of this Court that fire arm licence cannot be suspended on account of the pending enquiry for cancellation of fire arm licence. This legal position could not be disputed by the learned Standing Counsel. In view of this submission the matter requires scrutiny.
Issue notice.
Notices on behalf of respondents have been accepted by the office of the learned Chief Standing Counsel, therefore, notices need not be served again.
Learned counsel for the respondents prays for and is granted four weeks time to file counter affidavit. Rejoinder affidavit, if any, may be filed within two weeks thereafter.
List thereafter.
As an interim measure, without prejudice to the right and contention of the parties, the operation of the impugned order dated 12.5.2010 passed by A.D.M., City, Aligarh shall be kept in abeyance. However, it is observed that the proceedings with respect to the cancellation of the fire arms licence itself be concluded within a period of two months if the petitioner has filed reply to the notice. If the petitioner has not filed reply, it is directed that he shall file reply within a period of two weeks from today and thereafter within two months thereafter proceedings of cancellation be concluded.
