The present writ petition has been filed by the petitioners challenging the orders dated 21.8.2020 passed by the District Basic Education Officer, Hathras instituting an inquiry against the petitioners for having not complied with the transfer orders issued regarding them and for certain act of indiscipline committed by them after the transfer orders were served on the petitioners.
Through the impugned orders dated 21.8.2020, the petitioners have also been put under suspension and have been attached to B.R.C, Sicundrarau.
The counsel for the petitioners states that the petitioners are ready to join at their place of posting in terms of the transfer orders referred in the impugned order dated 21.8.2020.
The counsel for the petitioners has relied on the judgment and orders dated 1.12.2020 and 9.12.2020 passed by this Court in Writ A No.8734 of 2020 filed by certain Assistant Teachers similarly situated as the petitioners who were also put under suspension by the District Basic Education Officer on similar terms.
The petitioners may file a representation before the District Basic Education Officer, Hathras indicating their willingness to join at their place of posting in term of the previous transfer orders and for review of the suspension orders dated 21.8.2020 who on receiving the said application shall consider the representations sympathetically in light of the orders dated 9.12.2020 and 1.12.2020 passed by this Court in Writ A No.8734 of 2020 and shall pass appropriate orders on the said representation filed by the petitioners within a period of four months from the date a copy of this order is served before him along with the representation.
It is clarified that this Court has not expressed any opinion on the merits of the claim of the petitioners.
With the aforesaid direction, the writ petition is disposed of.
