Heard Mr. Anand Mohan Pandey, learned counsel for the applicant and the learned A.G.A. for the State.
This application under section 482 Cr. P. C. has been filed challenging the order dated 4.11.2016 passed by the Additional Chief Judicial Magistrate-I, Jhansi, in Complaint Case No. 338 of 2009 (M/s Haji Sons (Petrol Pump) Vs. Jay Narayan), under section 138 N.I. Act, P.S. Sipri Bazar, District Jhansi, whereby non bailable warrant has been issued against the applicant, the order dated 2.5.2018, whereby the process under section 82 Cr.
P. C. has been issued against the applicant as well as the entire proceedings of the above mentioned complaint case.
The non-bailable warrant was issued by the Court below against the applicant, vide order dated 4.11.2016. There is no explanation offered in the affidavit as to why in spite of the aforesaid order, the applicant could not appear before the Court below since then.
In view of the fact and circumstances noted herein above, no occasion arises before this Court to entertain this application.
It is, accordingly, dismissed.
