Heard Mr. Amal Darsingh, learned counsel for the petitioners and Mr. Adarsh Bhushan, learned counsel for the respondent - Mandi Samiti.
The only prayer made in the writ petition, reads thus:
"a. Issue an appropriate writ, order or direction in the nature of Mandamus, directing the respondent no.2 and its subordinates not to take any coercive action against the petitioner till disposal of his objection/representation dated 27.11.2015 pending before the respondent no.2."
We have perused the representation dated 27.11.2015. It appears therefrom that the respondent Mandi Samiti has already recovered Mandi fee from the petitioners. According to petitioners, the recovery was illegal.
The amount recovered from the petitioners, some time in 2011, was Rs. 11,000/-. In view thereof, in our opinion, no useful purpose will be served by issuing direction as prayed. Hence, the petition is dismissed.
