JUDGMENT / ORDER

The petitioner is a ministerial staff of the Civil Police. By the impugned order, he has been transferred from Civil Police to P.A.C.
The contention of the petitioner is that though both Civil Police and P.A.C. are governed by the Police Act but they are two separate independent departments having governed by the separate Rules and, therefore, the ministerial staff of the U.P. Civil Police cannot be transferred to P.A.C.
There is no authority on the subject. The matter requires consideration.
Let the learned Standing Counsel file counter affidavit within two weeks. Rejoinder affidavit may be filed within one week thereafter.
List in the week commencing 8.10.2012.
Till the next date of listing, in case if the petitioner has not joined the transferred post, the operation of the impugned transfer order from Civil Police to P.A.C. shall remain stayed.
