JUDGMENT / ORDER

The appeal and the delay condonation application in filing the appeal were dismissed as the counsel for the appellant had not taken steps. It is now being alleged that when the appeal was listed the case could not be marked and personal reasons have been assigned for not taking steps within time.
In view of above, the order dated 16.12.09 is recalled and the appeal as well as application is restored to their original number.
Counsel for the appellant may take steps within two weeks.
Application allowed.
