Heard Sri Dhan Pal, learned counsel for the applicant, learned standing counsel for respondent nos.1 and 2 and Sri Hemant Kumar for respondent no.3.
The petitioner who was an employee of respondent no.3 attained the age of superannuation on 31.10.2018. He claims that his pensionary benefits has not been extended by respondents. He has relied upon an order of this Court dated 27.7.2018, passed in Writ-A no.16102 of 2018 in which a direction was issued to respondent no.2 to decide the grievance of the petitioner in accordance with law in view of the law settled by the Apex Court in Civil Appeal No.7434 of 2016 (Habib Khan vs. State of Uttarakhand).
In view of the above, the writ petition is disposed of with a direction to respondent no.2 to consider and decide the representation of petitioner by a reasoned and speaking order within three months from the date of production of a certified copy of this order.
