Heard learned counsel for the applicants and the learned A.G.A. There is no reason to quash the proceedings of Complaint Case No. 3444 of 2009, Sami Rathi Vs. Bharat Yadav, under Sections 323, 504, 506 and 435 I.P.C., Police Station Belghat, District Gorakhpur pending in the Court of Additional Chief Judicial Magistrate, Court No. 17, District Gorakhpur since there is allegation against the applicants that they, with the help of police, set ablaze the thatched and the residential hut of the victim. The victim must get a chance to substantiate the levelled allegation.
The application is dismissed with a direction that the bail prayer of the applicants in the aforesaid crime be considered expeditiously, if possible on the same day.
