Heard Sri Brijesh Kumar Prajapati, learned counsel for the petitioner and learned Standing Counsel for the respondent No.1-State.
Sri Brijesh Kumar Prajapati, learned counsel for the petitioner contends that the petitioner is the widow of the deceased employee. The delay in deciding the compensation case has pushed her and her family to the point of financial destitution.
The only prayer made by Sri Brijesh Kumar Prajapati, learned counsel for the petitioner is that the case registered as E.C. Case No.2 of 2017 (Jai Devi and others Vs. Santosh Yadav and another) is pending before the respondent No.2/Employees Compensation Commissioner, Allahabad, be decided within a stipulated period of time.
Learned Standing Counsel submits that the respondents authorities are under an obligation of law to decide the case of the petitioner within a reasonable period of time.
Interest of justice will be served by issuing the following directions:
I. The respondent No.2/Employees Compensation Commissioner, Allahabad to decide the case registered as E.C. Case No.2 of 2017 (Jai Devi and others Vs. Santosh Yadav and another) within a period of three months from the date of receipt of a copy of this order downloaded from the official website of the High Court of Judicature at Allahabad, after giving an opportunity of hearing to all necessary parties to the lis.
The concerned Court/ Authority/ Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
The writ petition is disposed of.
