Counter affidavit filed by learned A.G.A. today in the Court is taken on record.

Submission made by learned counsel for the applicant is that the father of the girl has lodged the FIR under Sections 363, 366, 120-B IPC and Section 7/8 POCSO Act against as many as five named accused persons including the applicant. It is next submitted that applicant is the father of main accused-Vijay. The girl was eventually recovered after 27 days. Learned counsel for the applicant has drawn the attention of the Court to the statement of the victim recorded under Sections 161 and 164 Cr.P.C. which clearly shows that on her own volition and accord, she has joined the company of the applicant, went to Delhi and performed marriage and thereafter proceeded to Himachal Pradesh and resided as husband and wife.
