Heard learned counsel for the petitioner and Sri Sandeep Kumar Singh, learned counsel appearing on behalf of respondent-Bank.
Admittedly petitioner has defaulted in repayment of an agricultural loan taken from the respondent-Bank. A recovery certificate, dated 31.10.2015, for recovering of Rs. 1,25,989/- + interest, has been issued.
Petitioner submits that he is ready to deposit whole of the amount in easy installments.
Learned counsel for the respondent Bank has no objection.
Under the circumstances, this petition is disposed of directing the petitioners to deposit Rs. 25,000/-, out of the amount sought to be recovered, within one month from today, and the remaining amount would be deposited in four equal quarterly installments.
In case petitioner commit default in depositing any of the installments within the stipulated time, it will be open to the respondents to adopt coercive process which will not be objected to by the petitioner.
Subject to the above, this writ petition stands, disposed of.
