Heard Sri P.S. Yadav, learned counsel for the petitioner, Sri Irshad Hussain, learned A.G.A. for the State and perused the impugned FIR as well as material brought on record.
This petition has been filed by the petitioner with a prayer to direct the respondent no.3 to investigate the matter fairly and to arrest the respondent no.s 4 to 9 in pursuance of the FIR dated 18.11.2016, registered as Case Crime No.582 of 2016, under Sections 419, 420, 467, 468, 469 I.P.C., Police Station Khaga, District Fatehpur.
It has been contended by learned counsel for the petitioner that petitioner is the informant of the present case and he has come up before this Court with a prayer that direction be given to respondent no.3 for fair investigation in the matter as he apprehends that investigation is not being carried out in a fair and proper manner also to arrest the respondent nos. 4 to 9.He further submits that charge sheet has been submitted against the other co-accused Nirdesh Kumar but so far as accused respondent no.4 to 9 are concerned, investigation is still pending against them and no charge sheet has been submitted against them.
Considering the facts and circumstances of the case and submissions advanced by learned counsel for the parties, we direct the Investigating Officer of the present case to conclude the investigation of the present case and submit a police report before the Magistrate concerned expeditiously preferably within a period of two months from the date of production of a certified copy of this order.
With the above directions this petition is finally disposed of.
