Heard Shri R.N. Upadhyay holding brief of Shri Dharmendra Kumar, learned counsel for the petitioner and Shri Sujeet Kumar Rai, learned counsel for the respondents.
The petitioner in the writ petition is seeking a direction to the respondents to co-opt four Directors in the Committee of the Bank.
Shri Sujeet Kumar Rai, learned counsel for the respondents however informs that half of the term of the Committee is going to expire on 4.2.2019 and therefore fresh election cannot be held but Directors can be co-opted. He further submits that there are vacancies of six Directors.
We therefore dispose of this writ petition with a direction to the respondent no.1 Secretary, Committee of Management, District Cooperative Bank Ltd. Bulandshahr to take steps for co-opting the Directors in the Committee of the Bank as per Rules expeditiously preferably within a period of one month from the date of receipt of the certified copy of this order.
It is made clear that the court has not adjudicated the claim of the petitioner on merit.
