Counsel for the petitioner does not press the first relief as it is not related to petitioner. Further He fairly submits that in terms of the provisions contained in Sub section 4 of Section 38 of UP Revenue Code, 2006, the impugned order is appealable. He submits that if Commissioner, Saharanpur is directed to entertain the appeal on its own merits, he is willing to withdraw the writ petition.
Writ petition is dismissed as withdrawn with liberty to the petitioner to file appeal in terms of the provisions contained in sub section 4 of Section 38 of the UP Revenue Code, 2006 and if appeal is filed the same shall be considered and decided by the Commissioner on its own merit.
In view of above terms, the writ petition is dismissed as withdrawn.
